Employment Practices Counseling

It is challenging to be an employer in the State of California and to navigate the complex web of statutes and regulations related to employees. Our office regularly counsels employers in best practices to ensure that they are acting in compliance with the law, and that they avoid situations which may cause civil liability.

Wage & Hour Disputes

Wage and hour disputes typically arise when there are disagreements or conflicts between employers and employees regarding compensation for work performed. These disputes can involve various issues related to wages, hours worked, overtime pay and other related matters. Resolution of wage and hour disputes often involves legal proceedings, including filing complaints with government agencies such as the Department of Labor, pursuing arbitration or mediation or filing lawsuits in civil court.

Breach of Contract

A breach of contract occurs when one party fails to fulfill its obligations as outlined in a legally binding agreement without a valid excuse. This failure can be partial or complete. Breaches can take many forms, such as failing to perform on time, not performing in accordance with the terms of the agreement or failing to perform at all. When a breach of contract occurs, the non-breaching party may seek remedies such as damages, specific performance or termination of the contract, depending on the terms of the contract and applicable laws.

Discrimination Claims

If an employee is unfairly treated based on certain protected characteristics, such as race, gender, age, disability, religion, national origin or sexual orientation, it is considered to be discrimination. Discrimination claims can be complex and often require careful  and evidence gathering. We can help you protect your rights and seek any damages that may be due to you.

Harassment Claims

Workplace harassment refers to any unwelcome or offensive behavior regarding race, color, sex, national origin, age, disability or genetics that creates a hostile, intimidating, or uncomfortable work environment for an individual or group of people. It can take many forms, including verbal, physical or visual actions.
